{"id":22182,"date":"2021-01-29T13:32:44","date_gmt":"2021-01-29T18:32:44","guid":{"rendered":"https:\/\/health.uconn.edu\/graduate-medical-education\/?page_id=22182"},"modified":"2026-01-28T12:00:27","modified_gmt":"2026-01-28T17:00:27","slug":"family-and-medical-leaves-of-absence","status":"publish","type":"page","link":"https:\/\/health.uconn.edu\/graduate-medical-education\/cahc\/family-and-medical-leaves-of-absence\/","title":{"rendered":"FMLA, CTFMLA and Other Leave Policies"},"content":{"rendered":"<div id=\"pl-22182\"  class=\"panel-layout\" ><div id=\"pg-22182-0\"  class=\"panel-grid panel-no-style\" ><div id=\"pgc-22182-0-0\"  class=\"panel-grid-cell\" ><div id=\"panel-22182-0-0-0\" class=\"so-panel widget widget_black-studio-tinymce widget_black_studio_tinymce panel-first-child panel-last-child\" data-index=\"0\" ><div class=\"textwidget\"><h3 style=\"text-align: center;\">Leave Policy Overview<\/h3>\n<p style=\"text-align: center;\"><strong>ALL AVAILABLE LEAVES WILL RUN CONCURRENTLY AT ALL TIMES TO THE EXTENT ALLOWED BY LAW<\/strong><\/p>\n<p><strong>One-Time GME Leave Benefit<\/strong><\/p>\n<p>Beginning on the first day of employment, all residents\/fellows have up to 6 weeks of paid medical, family or caregiver leave available that may be used for qualifying reasons consistent with Connecticut law. This one-time leave will be paid at 100% of pay for both <strong>Medical<\/strong> and <strong>Family Leave<\/strong> reasons. Vacation and sick time for medical leaves, and vacation time for family leaves is required to be used toward the leave.<\/p>\n<p>Employees can reserve two weeks of vacation time for future use if available at the time of leave. If the first leave required is longer than 6 weeks or if a second leave is required during residency, the leave coverage available will fall under the CT Paid Leave Law. If the criteria for CT Paid Leave is not met and a leave greater than 6 weeks is required, the remaining leave will be an unpaid personal leave.<\/p>\n<p><strong>Qualifying Leave Reasons Under CT Law<\/strong><\/p>\n<ul>\n<li><strong>Medical Leave<\/strong>\u00a0\u2013 to care for your own serious health condition.<\/li>\n<li><strong>Non-Medical\/Family Leaves\u00a0<\/strong>\u2013 to attend to family responsibilities.\n<ul>\n<li><strong>Parental Leave<\/strong>\u00a0to bond with a newborn child or one that has joined the family through adoption or foster care.<\/li>\n<li><strong>Maternity Leave Post Medical Period<\/strong>\u00a0to bond with a newborn child once the medical leave period has ended.<\/li>\n<li><strong>Caregiver Leave\u00a0<\/strong>to care for a covered family member with a serious health condition.<\/li>\n<li><strong>Family Violence Leave\u00a0<\/strong>to attend to specific issues associated with family violence.<\/li>\n<li><strong>Military Exigency or Military Caregiver Leave\u00a0<\/strong>to attend to specific issues associated with a covered family member\u2019s deployment, care for an active duty injured service member, or to care for a veteran with a serious health condition.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul><\/ul>\n<p><strong>CT Paid Leave Benefit<\/strong><\/p>\n<p>All leaves of absence will be paid per Capital Area Health Consortium\u2019s (CAHC) CT Paid Leave Private Plan. To be eligible for CT Paid Leave, residents\/fellows must have been employed by CAHC for at least 3 months and meet the earnings requirement.<\/p>\n<p>The rates of pay are as follows:<\/p>\n<p>Medical\/Maternity Leave:<\/p>\n<ul>\n<li>Paid in full for the \u201cmedical leave\u201d period that the resident\/fellow\u2019s health provider indicates they are unable to work for health reasons. For maternity leave, the health provider will authorize 6 or 8 weeks depending on delivery type. An employee may be granted an extension of \u201cmedical leave\u201d by submitting updated medical documentation from their health care provider indicating the medical reason the extension is required.<\/li>\n<li>Additional leave time taken past the \u201cmedical leave\u201d period will be considered \u201cfamily leave\u201d and will be paid at the approved State rate (see below for further details).<\/li>\n<\/ul>\n<p>Family\/Non-Medical Leave:<\/p>\n<ul>\n<li>Paid at the State maximum benefit rate. As of 1\/1\/26, the rate is $1,016.40\/week or $2,032.80\/bi-weekly.<\/li>\n<\/ul>\n<p><strong>Accrued Time Requirement<\/strong><\/p>\n<ul>\n<li>For\u00a0<strong>Medical Leaves<\/strong>, vacation and sick time is required to be used, and for\u00a0<strong>Family Leaves<\/strong>, vacation time is required to be used prior to receiving any paid leave benefits under CAHC\u2019s private plan. Employees can reserve two weeks of vacation time for future use if available at the time of leave.<\/li>\n<\/ul>\n<p><strong>Leave Duration:<\/strong><\/p>\n<p>Medical and Family Leave under the CT Paid Family and Medical Leave Act is for up to 12 weeks of pay in a 12-month period. An additional 2 weeks of paid leave time may be provided for pregnancy incapacities. A maximum of 12 total days of paid leave compensation may be paid in a single calendar year for leave due to the Covered Employee being the victim of family violence.<\/p>\n<p><strong>Taxability of Paid Leave Income<\/strong><\/p>\n<ul>\n<li>FICA and FLI taxes are not required on paid leave income and will not be withheld from leave pay, resulting in a higher net leave pay. CT Paid Leave will continue to withhold Federal and State tax since leave pay is taxable under these jurisdictions.<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul><\/ul>\n<\/li>\n<\/ul>\n<p><strong>Leave Paperwork<\/strong><\/p>\n<p>All leaves of absence require specific paperwork verifying the need for leave and its beginning and ending dates. Early submission of this paperwork will help CAHC to provide the resident\/fellow with continuous pay so please submit as soon as possible. Please contact CAHC to obtain leave paperwork. Please be advised that all leave paperwork including return to work notes for medical leaves must be returned to CAHC and not to the program or the GME office.<\/p>\n<p><strong>Requesting Leave<\/strong><\/p>\n<p>In the case of foreseeable leaves, residents\/fellows must provide at least 30 days\u2019 notice to CAHC and their program before the leave begins. If the leave is unforeseeable, you must provide notice to CAHC and your program as soon as practicable.<\/p>\n<p><strong>Extending a Medical Leave<\/strong><\/p>\n<p>Residents\/fellows may extend a medical leave for the same condition by submitting updated medical documentation from their health care provider indicating the reason for the extension and an estimated return to work date.\u00a0<strong>A return-to-work note cannot extend medical leave. An extension must be provided by the health provider stating the medical need.<\/strong><\/p>\n<p><strong>\u00a0<\/strong>If the extension is for a new medical issue or condition, a new CTPFML application must be submitted.<\/p>\n<p><strong>Return from Leave<\/strong><\/p>\n<p>When possible, a resident\/fellow should provide their Program Director and CAHC with at least 2 weeks\u2019 advance notice of the date they intend to return to training.<\/p>\n<p>A return to work note from the resident\/fellow\u2019s health provider stating that they are able to resume work duties is required for all\u00a0<strong>Medical Leaves\u00a0<\/strong>of absence of 3 days or more or following any hospital visit (ED or inpatient) and must be submitted to CAHC before the resident\/fellow\u2019s return to work. A return-to-work note is not required for maternity leave that transition to a family leave.<\/p>\n<p>If a resident\/fellow is unable to return following a leave, they must contact CAHC, their Program Director, and the GME office as soon as possible.<\/p>\n<p><strong>Time Entry (MyEvaluations) When on Leave<\/strong><\/p>\n<p>Residents\/fellows are not required to log time when on approved leave. They may willingly enter time to keep up with it; otherwise, residents\/fellows will need to attend to it immediately upon return before the next closest pay period.<\/p>\n<ul>\n<li>For Medical\/Maternity Leaves \u2013 enter in the Sick\/Med LV category<\/li>\n<li>For Family\/Non-Medical Leaves \u2013 enter in the NonMedical LV category<\/li>\n<\/ul>\n<p><strong>Time Away from Training<\/strong><\/p>\n<p>Taking any leave, including legally allowed leaves such as CT Family and Medical Leaves (CTFMLA), Federal Family and Medical Leave (FMLA), or CT Paid Family and Medical Leave (CTPFML) (especially when multiple leaves or absences occur in the same contract year), may extend the time necessary to complete the program requirements for graduation or advancement to the next academic year as well as for Board eligibility (see <a href=\"https:\/\/health.uconn.edu\/graduate-medical-education\/wp-content\/uploads\/sites\/20\/2018\/03\/41E.pdf\" rel=\"\">Contract Extension Due to Leave Guidelines Policy<\/a>).
